SimpleHiit Terms of Service

1. License Grant

SimpleHiit is licensed, not sold, to you by SimpleHiit for use under the terms of this license agreement. SimpleHiit reserves all rights not expressly granted to you.

Subject to your compliance with the terms and conditions of this agreement, SimpleHiit grants you a limited, non-exclusive, non-transferable, revocable license to use SimpleHiit on Apple-branded products that you own or control and as permitted by the Usage Rules set forth in the Apple Media Services Terms and Conditions.

2. Scope of License

This license does not grant you any rights to use any SimpleHiit trademarks, logos, or trade names. SimpleHiit and all titles, characters, names, and other content of SimpleHiit are the property of SimpleHiit or its licensors and are protected by United States and international copyright, trademark, and other intellectual property laws.

3. Data Collection

SimpleHiit may collect, use, and transfer certain data from you and your device to provide and improve the app. By using SimpleHiit, you consent to the collection and use of data as described in our Privacy Policy.

4. No Warranty

SimpleHiit is provided "AS IS" and "AS AVAILABLE" and without warranty of any kind, express or implied. SimpleHiit does not warrant that the operation of SimpleHiit will be uninterrupted or error-free. SimpleHiit does not make any warranties regarding the performance, accuracy, or reliability of the app.

5. Limitation of Liability

To the maximum extent permitted by law, in no event shall SimpleHiit be liable for any consequential, special, indirect, or incidental damages arising out of the use or inability to use SimpleHiit, even if SimpleHiit has been advised of the possibility of such damages. Some jurisdictions do not allow the limitation of liability for personal injury, or of incidental or consequential damages, so this limitation may not apply to you.

6. Governing Law

This agreement shall be governed by and construed in accordance with the laws of the State of California, except that any portion of this agreement that is governed by federal law shall be governed by such federal law. This agreement shall not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded.

For residents of the European Union, this agreement shall be governed by and construed in accordance with the laws of the country in which you reside.

7. Termination

This license is effective until terminated by SimpleHiit. Your rights under this license will terminate automatically without notice from SimpleHiit if you fail to comply with any term of this license. Upon termination, you shall cease all use of SimpleHiit.

8. Third-Party Services

SimpleHiit may contain links to third-party websites or services that are not owned or controlled by SimpleHiit. SimpleHiit has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third-party websites or services.

9. Changes to Terms

SimpleHiit reserves the right to modify or replace these terms at any time. If a revision is material, SimpleHiit will provide at least 30 days' notice prior to any new terms taking effect. Your continued use of SimpleHiit after such changes constitutes your acceptance of the new terms.
